2. Scope

This Policy explains what personal data the firm collects, why it is collected, to whom it is disclosed, how long it is retained, and the rights available to data principals. It applies to this website, to enquiry and advertising forms operated by the firm including forms submitted through Facebook, Instagram and WhatsApp, and to the consultancy services the firm provides.

3. Personal data collected

Immigration matters are document-intensive. The categories below reflect what destination-country authorities require in order to decide an application.

  • Identity and contact details: name, date and place of birth, gender, marital status, residential address, telephone number and email address.
  • Identity documents: current and previous passports, and where a particular authority or process requires it, government-issued identifiers.
  • Education records: mark sheets, transcripts, degree and diploma certificates, and language test results.
  • Employment records: curriculum vitae, experience letters, salary records and employer references.
  • Financial information: bank statements, income tax returns, proof of funds, loan sanction letters, Guaranteed Investment Certificate documentation and evidence of source of funds.
  • Immigration history: previous applications, visas held, refusals and the reasons recorded for them, removals, and travel history.
  • Family information: particulars of spouse, children, parents and sponsors, including their personal data where a form or authority requires it.
  • Health and character information: medical examination results and police clearance certificates, where the destination country requires them.
  • Enquiry and website data: information submitted through the firm’s website forms and advertising lead forms, messages sent to the firm, and technical data such as IP address and cookie identifiers.

Health information and information concerning prior refusals are sensitive. The firm collects them only where the destination country’s process requires them and uses them for no purpose beyond the matter concerned.

4. Sources

Personal data is obtained directly from the data principal, in person, by email, by telephone, through messaging services, and through forms on this website or on advertising platforms. Where a data principal authorises a family member, sponsor or representative to deal with the firm, data may be received from that person. Where a person responds to an advertisement placed by the firm on a social media platform, that platform transmits to the firm the contact details submitted in the form.

5. Purposes of processing

  • Assessing eligibility for a visa, permit or other immigration outcome and advising on prospects.
  • Preparing, compiling, reviewing and submitting applications to the relevant authority on instructions.
  • Corresponding about a matter and responding to enquiries.
  • Arranging associated services on instructions, including language testing, medical examinations, biometrics appointments, courier services and educational admissions.
  • Maintaining the firm’s records, raising invoices, and complying with tax, accounting and other legal obligations.
  • Responding to enquiries generated through the firm’s advertising and contacting the enquirer about the service enquired about.

The firm does not sell personal data, and does not use it for advertising beyond following up the enquiry made.

6. Basis of processing

The firm processes personal data on the basis of consent given at the point of engagement or enquiry and, where applicable, on the basis of the legitimate uses recognised under the DPDP Act. Consent may be withdrawn at any time by the means set out below. Withdrawal may make it impossible for the firm to continue acting in a matter already in progress, and does not affect the lawfulness of processing carried out before withdrawal.

7. Disclosure

An immigration application cannot be made without disclosing the applicant’s data to the authority deciding it. The firm discloses personal data to:

  • Embassies, high commissions, consulates and immigration authorities of the destination country.
  • Visa application centres and outsourced service providers appointed by those authorities.
  • Educational institutions, their authorised representatives and admission platforms, where instructed to seek admission.
  • Banks and financial institutions, where a Guaranteed Investment Certificate, education loan or proof of funds is required.
  • Panel physicians and medical centres designated by the destination country.
  • Affiliated offices and associates of the firm, whether in India or abroad, where the conduct of the matter requires it.
  • The firm’s professional advisers and auditors, and courts, regulators and law enforcement agencies where the firm is required to disclose.

8. Transfers outside India

By the nature of the services instructed, personal data will be transferred outside India to the authorities and institutions of the destination country and, where the matter requires it, to affiliated offices or associates of the firm situated outside India. Recipients outside India handle personal data under the laws of their own jurisdictions. The firm transfers only what the relevant process requires.

9. Retention

The firm retains a matter file for seven years from the date the matter is closed, after which it is securely destroyed, unless a longer period is required by law, or the records are relevant to a live or reasonably anticipated dispute, or the client requests retention for a future application. Enquiry data which does not result in an engagement is retained for twelve months and then deleted.

10. Security

The firm applies reasonable security safeguards appropriate to the sensitivity of immigration files, including restriction of access to personnel engaged on the matter, secure storage of physical documents at the firm’s premises, access controls on digital records, and confidentiality obligations binding on personnel. In the event of a personal data breach the firm will notify affected data principals and the Data Protection Board of India as required.

No system of storage or transmission is entirely secure and the firm does not represent otherwise. Any suspected compromise should be reported to the firm immediately at the address in clause 12.

11. Rights of data principals

Under the Digital Personal Data Protection Act, 2023 a data principal has the right to:

  • Obtain confirmation whether the firm is processing their personal data, together with a summary of that data and of the parties with whom it has been shared.
  • Have inaccurate or misleading data corrected, incomplete data completed, and data updated.
  • Have personal data erased where it is no longer required for the purpose for which it was collected and no law requires its retention.
  • Withdraw consent to processing at any time, as readily as it was given.
  • Nominate another individual to exercise these rights in the event of death or incapacity.
  • Have a grievance heard and addressed by the firm, and to escalate it to the Data Protection Board of India.

12. Grievance redressal

Any concern regarding the handling of personal data, and any request to exercise the rights set out above, should be addressed to the Grievance Officer of the firm:

The firm accepts instructions only from persons aged eighteen years and above, and does not knowingly collect or process the personal data of children. The firm does not undertake tracking, behavioural monitoring or targeted advertising directed at children. Where the firm becomes aware that it holds a child’s personal data otherwise than in accordance with law, it will delete that data. Where an application requires particulars of a dependent child, those particulars are provided by the parent or lawful guardian instructing the firm and are processed solely for that application.
